SILBON SPAIN, S.L.U. , (hereinafter SILBON) has developed this privacy policy in order to comply with the obligations set forth in Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data, hereinafter the GDPR.
Our goal is to inform you about the specific aspects related to the processing of your data, including: the purpose of the processing, the contact details so you can exercise your rights, the retention periods of the information, and the security measures we adopt to protect your privacy.
This privacy policy is an integral part of the Legal Notice, so the provisions contained therein apply directly and/or vice versa, complementing each other.

Information we process
At SILBON, we may collect the following personal data: name, surname, address, postal code, locality, province, NIF or NIE, landline, mobile phone, gender, date of birth. All data is provided by you either because you provide it verbally when placing an order/purchase in our stores, or because you register on our website, app, or newsletter through the corresponding forms.
PURPOSE AND USE OF THE DATA
We will use your personal data for the following purposes:
1. Purchases.
Manage your purchases, make reservations for those products that are not available at the time of purchase, successfully carry out the contractual relationship, etc.
2. Online store.
Manage the orders placed through the website, send you information about the status of deliveries, and process product returns.

The data will be collected through the video surveillance cameras installed in our facilities.
8. Manage your rights.
Address the rights that assist you regarding the protection of your personal data.
Failing to provide personal data for the purposes we have indicated will result in the inability to register in our online store, place orders, provide the requested service, or receive information about SILBON's products and services.
LEGAL BASIS FOR PROCESSING AND RETENTION PERIOD
We will process your data based on the following legal bases:
1. Execution of a contract.
Your data will be necessary to execute the sales contract; failing to provide this data will result in the inability to provide the requested service (managing orders, making online purchases, responding to your information requests, etc.)
In this case, the data will be retained for as long as the business relationship lasts.
2. Legal obligations.

Entities related to SILBÓN, known as data processors, such as accounting and tax advisory, service providers, maintenance companies, etc., may access your personal data.
We may also communicate your data to public administrations and agencies to comply with legal obligations (for example, to the Tax Agency).
The service providers we hire are located in the European Economic Area, so we do not carry out international data transfers.
User-generated content (UGC)
At SILBON, we love to see how our community uses, combines, and shares our garments, accessories, and products in their daily lives. Therefore, we may request permission to publish photographs, videos, reels, stories, comments, or other user-generated content featuring products, looks, stores, events, or experiences related to SILBON.
These contents may be published mainly on our website www.silbonshop.com, product sheets, inspiration galleries, commercial landing pages, newsletters, marketing campaigns, catalogs, digital media, official SILBON social networks, and other corporate or promotional supports of the brand.
By responding affirmatively to our request for the use of content, for example through the hashtag #oksilbon, by expressly replying to the message sent by SILBON, or through any other enabled mechanism, you accept these terms of use for user-generated content.
1. Publication of photographs, videos, and other content.
The photographs, videos, or other content published on social media tagging, mentioning, or identifying SILBON, its products, stores, events, or official profiles may be reviewed by SILBON to assess their potential publication on our channels.
For us to view and select the content published on social media, your profile must be public or you must have provided the content directly through an authorized channel. Otherwise, we may not be able to access the content or request its authorization for use.
2. Content selection criteria.
SILBON will select content that highlights the products, style, values, and image of the brand, and that fits its visual identity. The content must clearly showcase at least one product, look, store, event, or experience related to SILBON.
SILBON reserves the right not to publish, withdraw, or cease using any content when it deems that it does not align with the brand image or applicable regulations.
3. Authorization for content use.
By authorizing the use of your content, you declare and guarantee that you hold the necessary rights over the photographs, videos, texts, or materials submitted or published, or that you have the necessary authorizations to allow their use by SILBON.
Likewise, you declare that you have the consent of the individuals appearing in the content. In the event that minors appear, you declare that you have previously obtained the authorization of their legal representatives.
By your authorization, you grant SILBON a free, worldwide, non-exclusive, and transferable license to suppliers, agencies, platforms, or collaborators acting on behalf of SILBON, to use, reproduce, publicly communicate, distribute, adapt, edit, crop, resize, reformat, subtitle, translate, or technically modify the content, in whole or in part, for promotional, advertising, commercial, corporate, or brand communication purposes.
This authorization includes the use of the content on the website www.silbonshop.com, official social media, newsletters, marketing campaigns, digital advertising, catalogs, corporate materials, physical stores, events, and other channels owned or managed by SILBON.
The authorization does not imply an exclusive transfer of rights, so you may continue to use your content. Unless there is an express written agreement, the authorization will not entitle you to remuneration, financial compensation, or any consideration.
SILBON may include your name, alias, social media username, or public identifier alongside the content, as long as it is appropriate for the channel or medium used.
4. Request for content removal.
You can request the removal of a photograph, video, or authorized content at any time by writing to protecciondatos@silbon.es or contacting the official SILBON profile that requested the authorization.
Upon receiving the request, SILBON will make reasonable efforts to remove the content from its own channels within a reasonable timeframe. The removal will not affect the legality of uses made prior, nor materials already produced, published, distributed, or disseminated before the receipt of the request, nor publications, shares, or uses made by third parties unrelated to SILBON.
5. Processing of personal data associated with UGC content.
In the context of managing user-generated content, SILBON may process the following personal data: name, alias, username or identifier on social networks, image, voice, audiovisual content, published text, messages exchanged with SILBON, and any other data included in the authorized content.
The purpose of the processing will be to manage the authorization request, verify the consent granted, publish the authorized content, promote the image of SILBON, showcase real uses of our products, and develop communication, marketing, and advertising actions for the brand.
The legal basis for the processing will be your consent, granted by responding affirmatively to SILBON's request or by using the indicated authorization mechanism. We may also retain certain minimum information to verify the granted authorization and address potential legal responsibilities.
You may withdraw your consent at any time, without affecting the lawfulness of the processing carried out prior to the withdrawal. This formulation fits better than an "irrevocable" authorization when the content includes image, voice, or other personal data, as the GDPR recognizes the withdrawal of consent without affecting previously validly carried out processing.
The data will be retained as long as the content remains published or as long as necessary for the indicated purposes. Subsequently, SILBON may retain the strictly necessary information to verify the granted authorization, manage the requested withdrawal, or address possible claims during the legally applicable periods.
When the content is published on social networks or third-party platforms, such platforms may process your data according to their own privacy policies and terms of use.
You can exercise your rights of access, rectification, deletion, opposition, limitation of processing, portability, and withdrawal of consent by writing to protecciondatos@silbon.es. Tambyou have the right to file a complaint with the Spanish Agency for Data Protection. The AEPD recognizes these rights as part of the applicable data protection framework.
6. Official social profiles of SILBON.
For the purposes of these conditions, the official profiles of SILBON on social networks and digital platforms linked from the SILBON website will be understood to be included, including, among others, Facebook, Instagram, YouTube, Pinterest, and TikTok.
RIGHTS
You can exercise the following rights:
1. Right of access.
You have the right to obtain confirmation about whether SILBON is processing your data or not, as well as to access the following information: the purposes of the processing; the categories of data being processed; the recipients or categories of recipients to whom the data has been communicated or will be communicated; if possible, the expected retention period of the personal data or, if not possible, the criteria used to determine this period.
2. Right to rectification.
You have the right to rectify your personal data when it is inaccurate. You also have the right to complete it when it is incomplete. If you are registered on our website, it may be easier for you to correct it directly by modifying your profile.
3. Right to erasure/right to be forgotten.
You have the right to have your personal data erased when the data is no longer necessary for the purposes for which it was collected, or when you withdraw your consent and the processing is not based on another legal basis.
4. Right to restriction.
You have the right to request the restriction of the processing of your data, in which case we will only retain it for the exercise or defense of claims.
